Bankruptcy, Debtor/Creditor Representation and Bankruptcy Litigation

At Howard Stallings From & Hutson, P.A., we represent creditors and debtors in bankruptcy proceedings, collection actions, and out-of-court restructurings. We also represent people and companies who have been sued by bankruptcy trustees or debtors in bankruptcy proceedings.

We routinely represents creditors in a broad range of legal matters, including state court collections, foreclosures, receivership proceedings, involuntary bankruptcies, motions for relief from stay, and objections to plans and to confirmation.

We also provide representation of business debtors in Chapter 11 (reorganization) filings, Chapter 7 (liquidation) and Chapter 12 (agricultural) bankruptcies, and in such diverse industries as real estate, construction, manufacturing, retail and service industries. We also represent business debtors in out-of-court restructurings and state court proceedings, such as receiverships. We also provide representation of taxpayers in collection actions brought by the IRS, the North Carolina Department of Revenue and other tax agencies.

We represent individual debtors in Chapter 7 and Chapter 13 proceedings, where we assist debtors in discharging their debts, keeping their houses and cars, and dealing with their creditors.

We also defend our clients in lawsuits filed in bankruptcy cases, including preference litigation, claims objections, and fraudulent transfer litigation. Our firm is experienced in representing Chapter 7 trustees, so we have an understanding of the dynamics of litigating and settling these cases.

Bankruptcy practice requires a unique set of skills. It requires a working knowledge of how businesses operate and an understanding of accounting. It requires litigation skills in conducting examinations of witnesses, reviewing documents, legal research and writing briefs, and oral advocacy, as well as mastery of the Rules of Civil Procedure, the Rules of Bankruptcy Procedure, and the Rules of Evidence. Finally, it requires a firm grasp of the Bankruptcy Code and knowledge of the workings of the Bankruptcy Court.
